As with any privilege, there are certain rules (zero drugs and weapons on board) and expectations that charterers should be aware of to ensure a safe and enjoyable yacht charter experience for all parties involved. In this article, we will discuss some key points that every charterer should keep in mind to avoid any potential mishaps.

1. Drugs on board, weapons on board

All boats have a zero tolerance policy regarding illegal drugs.

The MYBA charter contract addresses charterer behaviour in clause 13 “Use of the vessel: “The Vessel operates a zero tolerance policy and the possession or use of any illegal drops or any weapons (including firearms) is strictly prohibited on board the Vessel. Failure to comply shall be sufficrent reason for the OWNER to terminate the Charter or recourse against the OWNER, Stakeholder or Broker.”

2. Crew harassment

Chartering a yacht means you are not just renting a vessel, but also hiring a crew to make your experience comfortable and safe. It’s important to treat the crew with respect and appreciation, as they work hard to ensure that your trip is enjoyable.

The MYBA charter contract addresses charterer behaviour in clause 13 “Use of the vessel: :  “The CHARTERER shall ensure that the behaviour of the CHARTERER and his Guests shall not cause a nuisance to any person or bring the Vessel Into disrepute. The CHARTERER and Guests shall afford the Crew due respect at all times. No Crew member shall be subjected to any type of harassment, sexual or otherwise, by the CHARTERER or Guests at any time during the Charter Period.”

3. Smoking on board

Unless otherwise agreed, smoking shall be restricted to the exterior areas of the Vessel designated by the Captain.

4. Law and regulations

According to the MYBA contract, Clause 13: “The CHARTERER shall comply, and shall ensure that the Guests comply, with the laws and regulations of any country into whose waters the Vessel shall enter during the course of this Agreement.”

Be aware of the yacht charter company’s policy on the use of photographs taken on their yachts.

Do not use photographs without the permission of the photographer or the yacht charter company.
